Berenberg takes the protection of your personal data very seriously and adheres strictly to the rules of data protection. We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and further applicable laws. Under no circumstances will the data collected be passed on to third parties without your consent. The following presentation gives you an overview of how Berenberg guarantees the protection of your privacy and which data is collected for each specificl legal basis in accordance with Art. 6 Section 1 GDPR.
In connection with your access, data is stored on our servers for security purposes which may allow identification (e.g. IP address, date, time and pages viewed). Apart from the statistical evaluation of anonymous data records, there is no personal utilization. We store IP addresses for a period of up to 28 days. The storage takes place for reasons of data security, in order to guarantee the stability and operational safety of our systems. This data is not merged with other data sources.
Sign up to our Newsletter via "Double-Opt-In"
If you register on our pages for one of the newsletters, you can revoke your consent at any time with effect for the future.
In order to send you the newsletters offered on our website and ordered by you, we ask for your e-mail address via an order form and ask you for subsequent confirmation (so-called double opt-in procedure). After your registration you will receive an e-mail in which you will be asked to confirm your registration. This confirmation is necessary so that nobody can register with external e-mail addresses. These data are stored and used exclusively for the execution of the dispatch. The personal data which you communicate to us via our website or which you have communicated to us for the subscription of the newsletter will only be stored until the purpose for which they were entrusted to us has been fulfilled.
When you register and unsubscribe from the newsletter, we store the e-mail address, confirmation e-mails and IP address for a period of 12 months in addition to the respective time (date and time). If you no longer agree to the storage of your personal data or if it has become incorrect, we will, on your instructions, delete or block your data or make the necessary corrections, insofar as this is possible under applicable law.
Newsletter - Service Providers
If you are interested in our publications and newsletters, you are free to choose between the areas of Wealth and Asset Management, Forex Trading and Economics. Internally, we use a service provider called Inxmail which is managing the process of collecting your data, your consent and unsubscriptions on Berenbergs behalf. The legal basis for distributing the newsletters to you is always consent, collected via double-opt-in procedure (Art. 6 Section 1 lit. a) GDPR).
Newsletter - Impact Analysis
The newsletters contain a so-called "web-beacon", which is a pixel-sized file that is retrieved from the server at Berenberg when the newsletter is opened. Within the scope of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval can be collected. This information is used for the technical improvement of the services on the basis of the technical data or the target groups and their reading behaviour on the basis of their retrieval locations (which can be determined with the help of the IP address) or the access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. The evaluations serve Berenberg to recognize the reading habits of the recipients of newsletters and to adapt the content to the interests of these.

Embedded YouTube Videos
We have integrated YouTube videos into our online offering, which are stored on www.YouTube.com and can be played directly from our website. These are all integrated in the "extended data protection mode" in the interests of data economy, i. H. that no data about you as a user will be transmitted to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in paragraph 2 be transmitted. We have no influence on this data transfer
By playing the videos, YouTube receives the information that you have accessed the corresponding subpage of our website with your IP address. This takes place regardless of whether YouTube provides a user account that you are logged in to or whether there is no user account. If you are logged into Google, your data will be assigned directly to your account. If you do not want the assignment to your profile on YouTube, you must log out before activating the button. YouTube stores your data as a user profile and uses it for advertising, market research and / or needs-based design of its website. Such an evaluation takes place in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, although you must contact YouTube to exercise this right.

Google also processes your personal data in the USA and has submitted to the EU-US Privacy Shield, www.privacyshield.gov/EU-US-Framework.
The legal basis for establishing a connection and the data transfer with YouTube described above is your consent in accordance with Art. 6 Para. 1 S.1 lit. a GDPR.
If you have given your consent, our website will load Marketing Cookies from Google Analytics, a web analysis service from Google. The use includes the operating mode "Universal Analytics". This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus evaluate the activities of a user across devices.
A feature of Google Analytics we use are so-called UTM parameters. UTM parameters enable campaign-specific tracking. Such tracking is important for measuring the success of online marketing campaigns and is very helpful in the context of conversion rate optimization. We can find out how many users came to a certain link and also whether they prefer to click on an image or text link in a newsletter, for example. We cannot retrieve this information for specific individuals, but it is technically possible for Google to allocate this connection to e.g. your IP address, which is why it is data protection relevant.
Google Analytics uses so-called cookies, i.e. text files which are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, in the event that IP anonymisation is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. We would like to point out that on this website Google Analytics has been extended to include IP anonymisation in order to ensure anonymous recording of IP addresses (so-called IP masking). The IP address transmitted by your browser within the scope of Google Analytics is not merged with other Google data.
On behalf of Berenberg, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide Berenberg with further services related to website and internet use.
The personal data will be transferred to the USA under the EU-US Privacy Shield on the basis of the adequacy decision of the European Commission. You can retrieve the certificate here.
The data sent by us and linked to cookies, user IDs (e.g. user ID) or advertising IDs will be automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month.
You can revoke your consent at any time with effect for the future. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the Browser Add-on. Opt-out Cookies prevent the future collection of your data when visiting this website. To prevent Universal Analytics from collecting data across multiple devices, you must opt-out on all systems in use.

When you visit our website, we use so-called Functional Cookies, i.e. small text files that are stored on your computer and contain certain meta-information about your use of the website, e.g. whether you have previously consented to the use of Marketing Cookies and a security cookie called "Cerber". The first cookie will identify you for 14 months if you do not clear your browser cache, “Cerber” will actually never use any personal data, however, we are listing it in this policy for the sake of completely covering all our cookies.

You can prevent the storage of cookies by adjusting your browser software accordingly; however, we would like to point out that in this case you will not be able to use all functions of this website without complications, e.g. the website will ask for your consent in Marketing-Cookies every time you visit.
The legal basis for the use of these functional cookies is the predominant legitimate interests pursuant to Art. 6 Section 1 lit. f) GDPR, as your privacy is barely touched by the use of Functional Cookies and they ensure that the website functions in a smooth manner for the user.
PSD2 Open Banking Platform / API
To use our PSD2 Open Banking Platform, you will be guided through our PSD2 Developer Portal page to a link that connects you to the Open Banking Platform. This platform will take you to a login and overview page with all the API information and other links you will need to use. Using this landing page and the Sandbox will result in the collection and processing of the same personal data collected while you are browsing our homepage (See: "Our Website" and "Cookies and Webtracking").
